Terms and Conditions
According to the legislation of the Republic of
Latvia, owners of the onlines stores must specify the terms of delivery and
returns of goods, as well as the right of withdrawal. Such a disclaimer is
called a distance contract.
The
seller of goods offered at the online store www.bergs.lv SIA “MODE PLUSS”, registration nr.
LV4000320409, Elizabetes street 20, Riga, LV-1050, Latvia, e-pasts: [email protected], phone: +371 67288393, hereinafter the
Seller, on the one side, and the person placing the order, hereinafter the
Buyer, on the other side, enter into the following Distance contract:
The
Seller resolves to sell and deliver goods to the Buyer in accordance with the
Buyer`s order, while the Buyer resolves to accept the ordered products and make
the payment in accordance with the terms of the Distance contract.
Ordering, Delivery and Payment Procedure
The
Buyer orders goods through the website of the “MODE PLUSS” online store www.bergs.lv , indicating the type and number of
goods to be purchased.The Buyer has the opportunity to
pay for the goods using the payment tools built into the online store or by
paying the invoice prepared by the Seller and sent to the Buyer by e-mail in
accordance with the order. The invoice is drafted electronically and is
valid without a signature.
The
Seller ensures the delivery of the goods within 3-7 business days from the day
of receiving the payment for the goods in the Seller`s bank account. The time
of the delivery take 14-30 business days if the delivery address is outside of
Latvia. Delivery time does not include public holidays.

Price Policy
In
our online store prices are in Euro`s, include VAT.
By ordering the goods the final price is indicated.
Warranty
According
the Consumer Rights Protection Law the Buyer has rights to raise a claim about
good, which is not in compliance with provisions of the contract, during 2
years from the day of purchase of good.
Right of Withdrawal
The
Buyer has rights to withdraw from the contract within 14 days from receiving
the goods. The Buyer can withdraw from the contract by sending a letter of
withdrawal to the Seller`s e-mail address: [email protected] or by Post to the address of the
company MODE PLUSS: Elizabetes street 20, Riga, LV-1050, Latvia. The Seller
shall send a withdrawal form to the Buyer`s e-mail address upon request. The withdrawal letter form is available also HERE .
The
Buyer is obligated to return the goods to the Seller within 14 days after
sending the withdrawal letter. All expenses for returning the goods to the
Seller shall be covered by the Buyer.
The
Buyer may not exercise the right of withdrawal if:
- the ordered goods cannot be returned due
to their nature
- the ordered goods are made directly for
the Buyer by individual order
According
to Section 12, paragraph six of the Consumer Rights Protection Law of the
Republic of Latvia, “the consumer is responsible for ensuring the quality and
safety of the goods during the exercising of the right of withdrawal.
The
Seller reserves the right to refuse the Buyer`s right of withdrawal or the
Seller can deduct compension in the case that
- the goods do not correspond to their
original condition
- goods are damaged
- original brand-, price tags have been
removed
- the deadline for return the goods is
overdue
The Seller shall reimburse the costs of the returned goods to the customer within 14 business days from the date Seller receives the letter of the withdrawal. The Seller may withhold the refund until the Seller has received the goods back or until the Buyer has provided confirmation to the Seller that the goods have been returned.

Sattlement of disputes
In
case of problems the Buyer have to contact the Seller by e-mails: [email protected] .
The
Buyer`s complaints are considered within 7 business days from the date of
receipt of the complaint, sending the answer to the address indicated in the
complaint.
Data
Processing
By
entering the necessary information when placing the order on the online store
www.bergs.lv, the Buyer confirms that they have read the terms and agree that
the provided data will be used to accept the Buyer`s order and shipping the
goods in accordance with the requirements of the regulatory enactments. The
Buyer agrees to receiving e-mail notifications regarding the processing of the
order.
